Legal Review of Farmland Law and Vacant Fallow and Virgin Land Management Law

In 2012 the Myanmar government passed the Farmland Law and the Vacant, Fallow and Virgin Lands Management Law, two pieces of legislation focussed on land tenure security and the allocation of land for private agricultural investment. The legal analysis explores the two laws, assessing the implications that they have for smallholder tenure security of both lowland and upland ethnic cultivators, and what kinds of challenges will arise from them for Myanmar’s small agriculturalists. Informed by this, the analysis makes recommendations on how the two laws, and the direction of Myanmar’s future land policy, could be shaped to benefit and protect the nation’s smallholders.
